The Supreme Court announced yesterday that it has granted certification to review O’Boyle v. Borough of Longport, 426 N.J. Super. 1 (App. Div. 2012), an Open Public Records Act case. The Appellate Division’s decision is discussed here. The question presented, as phrased by the Supreme Court Clerk’s Office, is “Are the documents requested from the Borough protected from access under the Open Public Records Act because they are protected by the attorney work-product privilege and common interest doctrine?”
