The Third Circuit Grants En Banc Review in the New Jersey Sports Gambling Law Case

As discussed here, a panel of the Third Circuit, by a 2-1 vote, had affirmed a decision of the District Court that had blocked New Jersey’s Sports Wagering Act, N.J.S.A. 5:12A-17, from going into effect.  New Jersey sought en banc review, and the Third Circuit has now granted that petition.  The order granting that petition states that the panel opinion has been vacated, as is customary when en banc review is granted.  The matter will be listed for en banc hearing “at the convenience of the Court.”
