The Supreme Court Takes Up an Organized Street Crime Case

The Supreme Court announced that it has granted certification in State v. Cooper. The question presented, as phrased by the Supreme Court Clerk’s office, is “Did the trial court improperly instruct the jury that conspiracy is a predicate crime of N.J.S.A. 2C:33-30, promotion of organized street crime?” In an unpublished opinion, a three-judge panel of the Appellate Division rebuffed defendant’s argument on this score, and on all others, except that the panel found it improper to have imposed more than one extended term in prison, as the Law Division had done. The Appellate Division thus affirmed defendant’s convictions but remanded for resentencing.
