The Supreme Court Takes Up a Compassionate Release Case

The Supreme Court announced today that it has granted certification in State v. F.E.D. The question presented, as phrased by the Supreme Court Clerk’s office, is “Was defendant eligible for compassionate release under N.J.S.A. 30:4-123.51e?” Both the Law Division and, in an opinion reported at ___ N.J. Super. ___ (App. Div. Aug. 26, 2021), the Appellate Division, found defendant, a 72-year old man who has been serving two life sentences since 1982 after being convicted of three murders, and who now suffers from heart disease, ineligible for compassionate release.
