The Supreme Court Affirms in State v. Rosado

State v. Rosado, 256 N.J. 93 (2023). As discussed here, the Appellate Division, in an opinion by Judge Gilson, held that a January 3, 2002 amendment to the criminal statute of limitations, N.J.S.A. 2C:1-6, did not toll the five-year limitations period in effect in 1990, when defendant allegedly committed a sexual assault. The Supreme Court granted certification. Today, in a per curiam opinion, the Court affirmed, substantially for the reasons given by Judge Gilson. The vote was 6-0, with Justice Fasciale not participating.
