The Standard of Review of Administrative Agency Decisions

Oceanside Charter School v. New Jersey Dep’t of Education, 418 N.J. Super. 1 (App. Div. 2011).  On the merits, this decision, written by Judge Carchman, stands for a simple proposition:  a recipient of government-granted funds who does not comply with the conditions of the grant must return the funds.  For appellate practitioners, this case contains a nearly two-page summary of the key principles comprising the standard of review of administrative agency decisions.  The standard of review is very deferential to the agency, and the court affirmed the Department of Education’s decision that the plaintiff charter school was required to return the federal grant monies due to the school’s failure to comply with the terms of the grant.
