The Supreme Court announced this morning that it has granted certification in Beim v. Hulfish, 427 N.J. Super. 560 (App. Div. 2012). The decision of the Appellate Division was discussed here. The question presented, as phrased by the Supreme Court Clerk’s Office, is “where federal estate taxes were greater than they might have been if the decedent had died in a later year, is the corresponding loss in the heir’s anticipated inheritance recoverable as ‘pecuniary injuries’ under the Wrongful Death Act, N.J.S.A. 2A:31-1 to -6?”
