As reported here, the Supreme Court of New Jersey previously granted review of Hoffman v. Supplements Togo Management, LLC, 419 N.J. Super. 596 (App. Div. 2011), a putative consumer class action case . The Appellate Division’s decision that was to be reviewed was discussed here. The case has now been resolved, however, and the parties have filed a stipulation of dismissal. The issues of ascertainable loss under the New Jersey Consumer Fraud Act, N.J.S.A. 56:8-1 et seq., and whether and when class counsel may also serve as the class representative, the two areas as to which the Supreme Court granted review, will have to await another case.
