As discussed (and endorsed) here, the Third Circuit has proposed amendments to its Local Appellate Rules that would establish a filing deadline of 5 PM instead of midnight in order for a document to be deemed filed on a given day. The court solicited comments, the original deadline for which was February 18. The court has now extended that deadline to March 3.
There has been much discussion of the proposed amendments among appellate practitioners. Those who wish to make their voice heard by the Third Circuit now have more time to do so.
