The Supreme Court announced that it has granted certification in Rise Against Hate.org v. Cherry Hill Tp., a matter that also involves consolidated cases brought by the same plaintiff against Bridgewater and West Deptford Townships. The question presented, as phrased by the Supreme Court Clerk’s office, is “Are email addresses submitted by members of the public to a public agency to sign up for electronic newsletters and notices subject to disclosure under the Open Public Records Act?” After the trial courts in all three cases ruled that the information at issue was subject to disclosure, the Appellate Division reversed those decisions in an unpublished opinion by a three-judge panel.
