2018-19 Appellate Statistics From the Administrative Office of the Courts

The Administrative Office of the Courts has issued its 2018-19 Annual Report of the New Jersey Courts, which is available here. The following statistics for the Supreme Court and Appellate Division appear in this report.

There were 1,116 petitions for certification filed with the Supreme Court. The Court granted certification, direct certification form trial level courts, or leave to appeal in 116 cases. There were 1,555 motions filed with the Court, and the Court decided 1,490 motions. The Court heard oral argument in 73 appeals and filed 71 opinions.

There were 5,936 appeals filed with the Appellate Division in the 2018-19 Term. The eight panels decided 6,296 appeals, more than keeping up with its docket. There were 9,644 motions filed, and the Appellate Division decided 9,608 motions. In terms of opinions, the Appellate Division filed 3,038 opinions, of which 145 (4.8%) were published opinions. The total number of opinions represents over 90 opinions per Appellate Division judge, or nearly two opinions per week, every week. Considering that the Appellate Division rarely issues one-line “Affirmed on the opinion below” decisions as many intermediate appellate courts often do, that is quite a workload.
