The Senate Confirms Judge Fasciale and Rachel Wainer Apter for Supreme Court Seats

As expected, on Monday of this week, while I was out of action, the full Senate confirmed Governor Murphy’s two nominees to the Supreme Court. Judge Fasciale received a unanimous favorable vote, 37-0, while the vote to approve the Wainer Apter nomination was 23-14, with all Democrats who voted supporting the nomination and all Republicans who voted opposing it.

With this vote, the Supreme Court now once again has six Justices, along with one Appellate Division judge (Judge Sabatino) whom Chief Justice Rabner temporarily assigned to serve on the Court and who holds the seat left vacant when Justice Albin retired in July. That seat is still to be filled by a permanent appointee. Governor Murphy should promptly make a nomination and that nomination, once made, should be promptly considered by the Senate.
